By using Mushroom Wiki (the website mushroomwiki.org and the Mushroom Wiki apps, together the "Service") you agree to these terms.

Safety first. The Service provides probabilistic mushroom identifications generated by software, and educational content. It can be wrong, including about toxic and deadly species. Identification of any specimen you intend to eat must be confirmed by a qualified human expert. Never eat a wild mushroom on the strength of this Service. You use the Service at your own risk and are solely responsible for any decision to consume, sell or share a mushroom.

Accounts

You must be at least 13 to create an account and must give a working email address. You are responsible for activity under your account. You may delete your account at any time from the Account page.

Allowance, packs and plans

Free accounts receive a daily number of identifications. Packs and subscriptions purchased on the website are billed by Stripe; subscriptions renew until cancelled and can be cancelled from the plan page or by email. In the mobile apps, any purchases are made through the app store's own billing and are governed by its terms. Prices are shown before purchase; packs do not expire; unused allowance is not refundable except where the law requires.

Market board

The market board lets people post what they picked and message each other. SamLyd Holdings LLC is not a party to any transaction, takes no payment, verifies neither sellers nor mushrooms, and provides no guarantee of identity, quality, safety or legality. Selling wild mushrooms for food is regulated in many jurisdictions; the seller is solely responsible for identification, licensing and compliance with local law, and the buyer for their own diligence. Listings may be removed and accounts suspended for abuse.

Your content

You keep ownership of photos and text you submit. You grant us a licence to store and process them to operate the Service (for example to produce a report from a photo you send for analysis). Report sections generated at your request may be stored and shown to other users of the Service. Do not post content that is unlawful, infringing or harmful.

Intellectual property

The Service, its software, models, data compilations, game and writing are intellectual property of SamLyd Holdings LLC, all rights reserved. Third-party material (iNaturalist photographs, Wikipedia and Wikimedia Commons content, base models, weather and map data) remains under its own licences, credited where shown.

Disclaimer and limitation of liability

The full Disclaimer forms part of these terms. In summary:

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, SamLyd Holdings LLC is not liable for any loss, injury, illness or damage arising from use of the Service, including from inaccurate identifications or from any transaction arranged through the market board. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
